Employers are facing more uncertainty in the wake of a letter from the Equal Employment Opportunity Commission warning them that requiring a high school diploma from a job applicant might violate the Americans with Disabilities Act.

The development also has some wondering if the agency’s advice will result in an educational backlash by creating less of an incentive for some high-school students to graduate.

The “informal discussion letter” from the EEOC said an employer’s requirement of a high school diploma, long a standard criteria for screening potential employees, must be “job-related for the position in question and consistent with business necessity.” The letter was posted on the commission’s website on Dec. 2.

Employers could run afoul of the ADA if their requirement of a high school diploma ” ‘screens out’ an individual who is unable to graduate because of a learning disability that meets the ADA’s definition of ‘disability,’ ” the EEOC explained.

And libs wonder why employers are NOT hiring. CRAZY.

Maybe the next 'group' the Dems will do all they can to 'save' will be the learning disabled. And since that group has been greatly enlarged to include all sorts of people, they will have generated a new voting block for themselves.

Imagine libs everywhere demanding they be certified as learning disabled so they can get a job. Certifying their 'illness' should be easy...

“While an employer is not required to ‘prefer’ a learning-disabled applicant over other applicants with more extensive qualifications, it is clear that the EEOC is informing employers that disabled individuals cannot be excluded from consideration for employment based upon artificial barriers in the form of inflexible qualification standards,” she wrote in a blog post.

So, it's possible that maybe eliminating someone with, say for example dislexia, who couldn't graduate from high school due to an inability to read could violate the ADA. Now, if reading is not required for the job, why require a high school diploma?

I know a man with that very problem. Ask him to fix anything from a watering system to a vehicle, and he's able to do it. Read a complex page, write a letter, not so much. Now, I graduated from HS many years ago, but couldn't do this man's job.

This is an example of how inflexible requirements may not be the best way to hire someone.

You see back in the 50s you didnt need a high school diploma to get a job. I support this law. Back in the 50s and beyond you must hire the guy if he thinks he capitable doing the job. You see its doctors who dictate whatever school you belong in. And there were no special ed schools back in the 50s. This is why you have crime people killing for money. Cause if you didnt graduate then you cant get a decent job you get yourself a gun go to a 7-11 store or to a gas station tell the clerk open cash register and give him the money when he gives it to you you run but if Clerk shoots you if youre black, The cops arrest him and he goes to prison. This is why some people dont want to work at a 7-11, a gas station or at a Pharmacy cause theyre too many risks involved.You cant get a good job like working for a construction company or an factory unless you got the high school diploma.
