Perhaps they were smart to not decide on this--but send it back to the legislature for the people to decide.

A hot potato they tossed back.

And--shitcanned the Commerce Clause. For all eternity.

I agree. It's the SCOTUS' job to make tough decisions, not to legislate from the bench, and that's what Roberts did.

yes he ignored the language of the law itself and was called out on it in the dissent.
but
he did insure it gets a second look in Congress and there will be no dark of night trickery available to the left.

it aint right but its a cheap way out that shuts the mouth of whiny leftists AND highlights the tax aspect of it on the biggest stage available. a pretty good one-two-three combination.

and I do get a kick out of how he schooled the administration lawyers on h9ow to make a case.

It is the job of SCOTUS to judge the legality of things--and nothing more.
I think this odd and circuituous decision may have been better than judicial legislating from the bench.
They punted it back to the legislatures and the people--and perhaps that is the right decision.
They refused to validate it--just opened the door for more legislation--via the voting booth in November.
They are always odd ducks.
I liked the dagger in the heart of the Commerce Clause--the real win here.

I don't think it changed anything in the commerce clause. It's still the same as it was. Maybe this just brought the point home a little clearer.

A reporter inside the Supreme court when the opinions were read said that J. Kennedy (who is a notorious swing voter) seemed visibly angry when he read his descent.

Roberts is never going to live this down with the right or it appears even his peers on the bench. Even Ginsberg wrote a descenting opinion, and she's a wack-job liberal who voted with Roberts.

I suppose the all suffer from a Messianic Complex--look at the drama they still shroud themselves in--needlessly.
Time for reform there. Or maybe electing them--with greater numbers.

Yes, I think so.
And--it will do so anyway.
The November election is the place where people can decide if they want this monstrosity--or--NOT.
In a way--a double-down to see if the people want socialism in medicine.
An interesting turn of events.
 
The state medicaid thing should throw a monkey wrench in the works. I'll bet that even liberal states that are under water won't expand theirs either. That means the new crop of medicaid people would have to be put into the Government exchanges. But you know how vindictive Obama is. He would probably stop any Government contracts from going to those states and sue their butts every chance he gets.

they'll threaten in hopes that the feds will feel forced to continue picking up the full tab. won't matter as there won't be docs to sign on as medicaid providers. they already struggle finding these.
 
I have not heard a single peep yet about the Health Plan for CONGRESS.
Are they still to be pampered and sent to special places?

Probably. They will probably also be exempt from the "cadillac plans". Doesn't that stink? If your employers gives you great insurance, you will be taxes on it.
