He was the spitting image of the killer, had the same first name and was near the scene of the crime at the fateful hour: Carlos DeLuna paid the ultimate price and was executed in place of someone else in Texas in 1989, a report out Tuesday found.

Even "all the relatives of both Carloses mistook them," and DeLuna was sentenced to death and executed based only on eyewitness accounts despite a range of signs he was not a guilty man, said law professor James Liebman.

Liebman and five of his students at Columbia School of Law spent almost five years poring over details of a case that he says is "emblematic" of legal system failure.
DeLuna, 27, was put to death after "a very incomplete investigation. No question that the investigation is a failure," Liebman said.

The report's authors found "numerous missteps, missed clues and missed opportunities that let authorities prosecute Carlos DeLuna for the crime of murder, despite evidence not only that he did not commit the crime but that another individual, Carlos Hernandez, did," the 780-page investigation found.

Texas Tea what you have to say about your state excutes a wrong man. Governors and Presidents can make mistakes that lead to murder. A private citizen cant. Maybe Europe is right,,Abolish the death penalty and you get life in prison without parole

This shows that it's about time that the death penalty was abolished . It doesn't work fairly, and miscarriages of justice like this happen.
The death penalty does not reduce crime or make us safer . Every U.S. state without it has a LOWER murder rate than those which do.
The death penalty was apolished long ago in every European nation, and their murder rates don't even come remote to
ours.
Life imprisonment actually costs less than exectuting some one, because of th e lengthy appeals . And it's anything but
a picnic .
 
One mistake would not mean the whole system needs to be abolished.

I do think this case is worth discussing since in the past on this forum it was claimed that no one has been wrongly executed. Lets hear from those that would say this man was not wrongly executed.

its been argued that its been quite some time since any such incident and lets face it, this was 1989.
 
I say life in solitary confinement. This is where you stay,Eat and sleep til the day you die.

Its solitary confinement. Once you get in you dont get out. You are there all by yourself no one to see or visit you. NO TV!,NO BOOKS And NO NEWSPAPER!

in Germany its 6x8, "bed" is similar just a mat on block and the facilities is a trough along the back wall. any cleaning is accomplished via hose without opening the door. thats spartan.

In England in the 1500's people were allowed visitors - who else was going to bring them food?

Seriously, we obviously need reform but I don't think solitary is it.
