The death penalty is vastly underused, we need to broaden its scope to include the kinds of people that cause the destruction of society. Nobody convicted of selling drugs twice should need to be arrested again. That would allow us to have more space available in prisons to keep people long enough on the first conviction to make a proper impression on them. Think about how much lower the crime rate would be if we had enough empty space in prisons to keep shoplifters for 5 years for the first offense and 15 years for the second offense. Stealing would be rare. People convicted of assault would get 10 years in a prison with just one giant cell block where they could beat each other up everyday. With any luck none of them would finish 10 years. A second offense, -death penalty. Punishment needs to be strong enough to deter crime with fear of consequences unpleasant to the point of abject terror in the hearts of criminals. Think about rap sheets on a 3" x 5" card, one side only...Are crimes committed by “mistake”? The only mistake is getting caught. We don’t owe criminals anything other than punishment.
