Those soldiers would abide by the Uniform Code of Justice. As much as you are trying to stretch this and that to make some case, you simply have no legal authority to do anything you are advocating. The legal authority for Bush to do exactly what he has done is well founded and backed by multiple OLC decisions and legal precedence. The fact that you do not like it hardly makes it illegal. Nor does your ridiculous interpretation of the Constitution.
