It may be a state of being, or it may not. However, homosexual behavior is defined. We regulate behaviors all the time. Sex is a natural human behavior, yet I've lived my life under constant regulation of this behavior. No sex in public--no sex with subordinates--no sex with minors, etc. Comparing the debate over homosexual rights with the historical and ongoing battles against racism is disingenuous.
