Schenck v. United States was overturned by Brandenburg vs Ohio 1969. It was a horrible decision. It involved a person handing out anti war pamphlets to soldiers embarking for Europe in WW1. The SC argument is that free speech rights were usurped by a clear and present danger which was nonsense.
